Abstract
In the present study we aim to answer a number questions according to Articls 190 and 217 of civil law which verify basic terms of trading accuracy and influence term of illegitimate motive in nullity of transactions such as: Can we discuss about the legitimacy of motive in Ayqaat? In other words, whether the word of transaction includes Ayqa or not? Therefore, if we consider such a topic in Ayqaat, should we consider all the other necessary terms in Ayqaat for influencing of illegitimate motive that we consider in contracts?
The response is that, in order to comply with the provisions of Article 190 of civil law in both categories of legal acts, we should literally consider the word of “stipulation” in the Article 217 of civil law. In this way, discussing about the legitimacy of Ayqaat is also possible.
