Abstract

Human rights are primarily used as rules for balancing unequal relations between governments and people, that is to say, human rights are mainly used in the sphere of public law. However, the capacity of human rights to be used in private relations is disputed. The stated question is: taking into account the common usage of human rights in public law relations, are they also applicable to personal relations between individuals in the society? In other words, are the human rights applicable to the sphere of private law? This study has studied the matter through analytical approach and has come to the conclution that human rights are universal rules which, considering their different vertical and horizontal functions, are applicable to both public and private law domains, and can be exercised in private relations.
