Local and international laws couldn’t grow along with rapid growth which e-commerce caused in local and international level. This issue is manifested more especially when e-commerce goes beyond local borders. In this regard, there is a type of supervisory gap which may give the unexpected results for the companies in charge of e-commerce which are involved legal claims. The present paper studies feasibility of using the concept of e-commerce custom as a legal source and also as a potential solution for resolving legal disputes relating to international e-commerce contracts. Based on this offer, e-commerce promotes some of the most common methods in web to law level with which it gives a flexible set of rules and criteria relating to the performed transactions in the network. Electronic custom also can complete local laws in the field of e-commerce and also the future international laws relating to e-commerce. In addition to the above cases, this paper intends to study place of international custom and provide a solution for the problems in e-commerce contracts.
