Criticism of the European Union's strategy for the rights of persons with disabilities, from the perspective of the right to fair trial

Abstract

People with disabilities face many challenges throughout their lives. Considering these challenges and with the aim of providing, encouraging and facilitating the implementation of the fundamental rights of these people, the European Commission approved the European Union strategy on the rights of people with disabilities in March 2021. The possibility of access of people with disabilities to justice and fair trial and the challenges in this field have led to widespread concerns by human rights activists. The present article examines the strategy of the European Union with a critical approach and using the analytical-descriptive method, in order to determine whether, considering the existence of general and structural flaws in the text of the strategy, the European Commission has been able to address the various dimensions of the legal challenges in Pay attention to the access to justice for people with disabilities. It seems that the commission has not been very successful in this field and the strategy regulations in the field of access to justice and fair trial are not able to deal with the challenges in this field.
