تعادل نوآوری و حقوق بشر: چالش‌های حقوقی و اخلاقی کاربرد هوش مصنوعی در نظام عدالت کیفری

چکیده

رشد شتابان استفاده از هوش مصنوعی (AI) در حوزه‌های حقوقی و قضایی، نظام‌های حقوقی را با چالش بهره‌گیری از این فناوری و همزمان تضمین حقوق افراد مواجه کرده است. نظام عدالت کیفری به‌عنوان یکی از حوزه‌های حساس، نیازمند تعادل بین نوآوری‌های فناورانه و رعایت اصول حقوق بشر است. این پژوهش با روش توصیفی- تحلیلی، در پی پاسخ به این پرسش است که به منظور تعادل بین فناوری و حقوق بشر برای تحقق عدالت در عرصه کیفری چه چالش­هایی وجود دارد. یافته‌ها نشان می‌دهند که استفاده از سیستم‌های هوش مصنوعی، به‌عنوان نماد نوآوری و کارایی، نیازمند حفظ تعادل بین اتکا به داده‌های الگوریتمی و رعایت شفافیت، نظارت انسانی و اصول حقوق بشر است. در ایران، اسنادی نظیر سند ملی هوش مصنوعی (مصوب ۱۴۰۳)، قانون برنامه هفتم توسعه (مصوب 1403)، آیین‌نامه اجرایی نحوه استفاده از فناوری‌های نوین در فرایندهای قضایی (مصوب ۱۴۰۴)، و دستورالعمل هوشمندسازی و الکترونیکی شدن فرایندها و پرونده‌های قضایی (مصوب ۱۴۰۳) چارچوبی برای استفاده مسئولانه از هوش مصنوعی فراهم می‌کنند. با این حال، فقدان مکانیزم‌های اجرایی دقیق و استانداردهای شفافیت، خطر نقض حقوق بنیادین مانند حریم خصوصی، اصل برائت، و منع تبعیض را افزایش می‌دهد.
