Rereading the Mutual Effect of Intention and Duration of Marriage and Its Correction Solutions

Abstract

Famous jurists are of this opinion: "If the duration of the marriage is not mentioned, it becomes permanent". The aim of the present study is to find a solution to this fundamental research question and This opinion violates the mutual influence between intention and duration of marriage. The mentioned violation has caused another opinion of the jurists on the nullity of such a contract. Although there is a research paper in the background of the research, it has not ended the dispute by providing a solution acceptable to the parties. This situation has caused the present research question that: "The Conversion of a broken marriage to a permanent one in case of leaving the period can be corrected with which jurisprudential solution, so that it does not lead to a violation of the rule of intention or a violation of the legal principles and rules and the famous fatwa referred to in Article 167 of the Law Basic and Article 3 of the Civil Procedure Law justify it?" The research method in finding the answer to this question is analytical and using library tools, and it has come to the conclusion that: In the mentioned article, several solutions have been presented to correct the research problem.
