چکیده
مؤسسان باشگاههای ورزشی ممکن است برای رفع مایحتاج خود پیش از تشکیل باشگاه، قراردادهایی را منعقد نمایند که این قراردادها به اعتبار باشگاهی که شخصیتی مستقل از مدیران و طرفین قراردادها دارد، بسته میشود. در نتیجه این سؤال پدید میآید که ماهیت اینگونه قراردادها از منظر حقوق قراردادها به چه صورت است؟ قرارداد صحیح بوده و دارای آثار حقوقی است یا خیر؟ در مقاله حاضر با در نظر گرفتن اصل حسن نیت در قراردادها و در حالی که باشگاه ورزشی هنوز به مرحله تشکیل نرسیده است، این نتیجه به دست آمد که چون طرفین قرارداد برای قراردادها دارای حسن نیت بوده و از اینرو بیم ورود زیان به طرف دیگر قراداد، به جهت امکان انتساب تعهد و زیان احتمالی به صورت تضامنی برای مؤسسین و باشگاه وجود دارد، از اینرو میتوان چنین قراردادهایی را صحیح تلقی نمود. روش تحقیق مقاله به صورت توصیفی تحلیلی است و سعی شده از منابع مرتبط و تخصصی استفاده شود.
