مسائل حقوقی نوظهور در فضای سه‌بُعدی متاورس

چکیده

دنیای مجازی با ویژگی­های منحصر به فرد، به افراد امکان می­دهد تا فضاهای دیجیتال را کشف کرده و با سایر کاربران تعامل داشته باشند. متاورس ابزاری برای توسعه تجربیات زندگی انسان، گستره­ای نامحدود و عمومی و یک فضای زندگی مجازی است. الزامات و بسترهای متاورس و به­طور خاص الزامات حقوقی آن، به اندازه­ای که این جهان در حال گسترش است، رشد نکرده است. هدف این مقاله که به روش توصیفی - تحلیلی نوشته شده است، بررسی موضوعات نوظهور حقوقی در متاورس و ارائه رهیافت­های نوین برای حصول به راهکارهایی در این زمینه است. به طور مشخص سه موضوع مالکیت و مالکیت معنوی، نشان­های غیرقابل تعویض و مالیات و حقوق مسئولیت مورد بررسی قرار گرفت. بلاکچین و قراردادهای هوشمند می‌توانند برای قانونی کردن بسیاری از حمایت­های بایسته از مالکیت؛ به ویژه مالکیت فکری در اکوسیستم متاورس مورد استفاده قرار گیرند. نشان­های غیرقابل تعویض از مصادیق قراردادهای سرمایه­گذاری محسوب شده و مانند اوراق بهادار مشمول مالیات قلمداد می­شوند. راجع به مسئولیت حقوقی آواتارها در متاورس، ضمن شناسایی«شخصیت الکترونیکی» برای آنها، حسب میزان وابستگی آواتار به تولیدکننده، تئوری­های «مسئولیت محض» و «مسئولیت مستقیم» مطرح شده است. با وجود این، به نظر می­رسد که توانایی انطباق قوانین و مقررات با رویدادهای در حال تغییر در متاورس و تغییر رویکردی ذاتی در قوانین، نحوه مدیریت این جهان-که درک آن از نظر فنی نیز دشوار است- بزرگ­ترین چالش حقوقی در این زمینه قلمداد می­شود و حقوق همچنان ناظر رخدادها و چالش­های در حال ظهور است.
