The Application of Good Faith and the Estoppel Rule in International Commercial Arbitration Claims

Abstract

The study of ICC cases has shown that the principle of good faith has been repeatedly invoked on specific issues. In general, good faith, as a flexible and fluid concept, has played a significant role in protecting legitimate contractual expectations in numerous cases. One example of the application of good faith is the estoppel rule. The estoppel rule has been used in various cases to answer the fundamental question of whether, if the defendant against the arbitral award challenges the arbitral award in the court of the seat of arbitration, the court of the place of enforcement of the arbitral award must comply with the award issued by the courts of the country of the seat of arbitration, and also, if there is no objection to the arbitral award in the country of the seat of arbitration, whether there is a possibility of filing a petition to annul the arbitral award in the country of the place of enforcement. In various cases, different positions have been taken in light of the estoppel rule, which we will examine in this study using an analytical-descriptive method and with the help of library and document retrieval tools. The materials presented in this study show that the estoppel rule, as a subset of the principle of good faith, has been invoked in various situations to prevent abuse of the litigation process.
