چکیده

یا استفاده روزافزون از فضای مجازی مسائل جدیدی نیز ظهور پیدا کرده است. بی‌گمان یکی از مسائل اصلی این است که پس از مرگ کاربران چه سرنوشتی در انتظار حساب‌های آنها در فضای مجازی و نیز، محتویات این حساب‌ها خواهد بود؟ در مقام پاسخ به این پرسش، باید توجه داشت که حساب از آنِ شرکتی است که آن را ایجاد می‌کند و به کاربر تنها اجازه استفاده از آن را می‌دهد. برای همین، با مرگ کاربر، این اجازه از بین خواهد رفت اما اطلاعات، مخلوق عمل خود کاربر است، پس متعلق به اوست. حال، آیا این سخن بدین معناست که اطلاعات پس از مرگ کاربر به وراث او خواهد رسید؟ برخی بر این اعتقادند که اطلاعات مجازی همچون اموال مادی به ارث خواهند رسید اما این قیاس نارواست: اموال مادی برخلاف اطلاعات موجود در فضای مجازی، کمتر می‌توانند حریم خصوصی مالک و به ویژه، اشخاص ثالث را نشان دهند، بر همین اساس و در راستای حفظ حریم خصوصی، به نظر می‌رسد تنها مالکیت اطلاعاتی که خود کاربر پیش از مرگ به صورت عمومی نشر داده و نیز، آن دسته از اطلاعاتی که ارزش مالی دارند یا به امور مالی فرد مربوط می‌شوند، به وراث خواهد رسید. قاعدتاً سایر اطلاعات که افشای آنها حریم خصوصی شخص را نقض می‌کند، باید از بین بروند یا آنکه با گذشت مدت طولانی پس از مرگ کاربر به صورت عمومی افشا شوند.
