The reasoning in the decision, "the difference in pay employees the government in the implementation of employment legislation required to implement it with government deals as well as trading and obligations of the parties" is expressed. The basis that is not acceptable by the general rules of contracts. <br />So check it is important that what is the difference between the delay payment of salaries of government employees and other natural persons or legal liabilities? And demand for the delay in payment of salaries of public servants and pay for it can be based on what rights jurisprudence? Recognizing this necessity this study explains, reviews and assesses the judicial precedent and then with legal proofs and legal arguments, proves the foundations permits compensation of delayed payment of state employees. <strong>چکیده</strong><br />به موجب رأی وحدت رویه شماره 156 دیوان عالی کشور، مطالبه خسارت در ازای تأخیر در تأدیه حقوق کارمندان دولتی و پرداخت آن از سوی دولت ـ با وجود به رسمیت شناختن این موضوع از سوی قانونگذار در سایر موارد تأخیر در ادای بدهی توسط اشخاص حقیقی یا حقوقی ـ مجاز نمی­باشد. مبنای استدلال در این رأی، «تفاوت برقراری و پرداخت حقوق مستخدمین که دولت در مقام اجرای قوانین استخدامی مکلف به اجرای آن است با معاملات دولت و همچنین معاملات و تعهدات اشخاص» بیان شده است؛ مبنایی که از نظر قواعد عمومی قراردادها مورد پذیرش نیست.<br />بنابراین بررسی این نکته ضروری است که چه تفاوتی میان خسارت تأخیر تأدیه حقوق کارمندان دولت با سایر دیون اشخاص حقیقی یا حقوقی وجود دارد؟ و مطالبه و پرداخت خسارت تأخیر در تأدیه حقوق کارمندان دولتی، بر چه مبانی فقهی و حقوقی می­تواند استوار باشد؟ این پژوهش با درک این ضرورت بر آن است رأی وحدت رویه مذکور را تبیین، نقد و ارزیابی نماید و در پی آن، با استدلال به دلائل فقهی و حقوقی، مبانی جواز دریافت خسارت تأخیر تأدیه حقوق کارمندان دولتی را به اثبات رساند. https://clk.journals.pnu.ac.ir/article_5427_3b7225c1f6b2929b7b1d3ab8f75e228f.pdf
