The distinction between the competence in public law and the capacity in private law is related primarily to classic distinguish between public law and private law. To understanding the nature of the competence is involved factors such as the rule of law, the limitation of power, the classification of legal norms and the administrative and the regulatory- organizational hierarchy, Therefore, by this distinction, is stems results including the being right of the capacity and the obligatory of  the competence. Therefore, the purpose of the lack of capacity is the individual interests and the purpose of the lack of competence, is the public interest. This distinction between the capacity and the competence is bring to specific legal effects. In other words, is caused distinction in monitoring between the capacity and the competence. The other legal effects resulting from the recent distinction, the difference in the reference procedure between the capacity and the competence, because the scope of the competence claims may be constitutional or administrative proceedings so they have a different reference compared with the capacity claims that proceed in General Courts, are processed to the Court of Administrative Justice. <strong>چکیده</strong><br />دو قاعده مهم و بسیار حائز اهمیت در حقوق، مفهوم «اهلیت» در حقوق خصوصی و «صلاحیت» در حقوق عمومی است. این دو گرچه در نگاه اول بسیار به یکدیگر شباهت دارند، اما با بررسی بیشتر می‌توان به تفاوت‌های عمده‌ای که میان این دو وجود دارد، پی برد؛ بنابراین به‌تبع این تفاوت‌ها، آثار حقوقی خاصی نیز از این دو نشأت می‌گیرد که بر هر یک از این دو مفهوم، مترتب می‌باشد. از جمله این آثار می‌توان به تفاوت در نظارت اشاره داشت. هدف اساسی از نظارت در حقوق عمومی، جلوگیری از فساد و کنترل کیفیت انجام وظایف و صلاحیت‌های محوله به مقامات عمومی است؛ اما نظارت بر اهلیت در حقوق خصوصی، اهمیتی مانند نظارت بر صلاحیت در حقوق عمومی را ندارد. اثر حقوقی دیگری که بر این دو مفهوم حاکم است، تفاوت در مرجع دادرسی رسیدگی به دعاوی مربوط به اهلیت در حقوق خصوصی که به‌وسیلة دادگاه‌های دادگستری صورت می‌گیرد و صلاحیت در حقوق عمومی که بسته به نوع و ماهیت دعوی به لحاظ اساسی بودن، اداری بودن مرجع رسیدگی بدان نیز متفاوت خواهد بود. ازاین‌رو در نوشتار حاضر به‌دنبال بررسی مسائل مطرح‌شده با دیدی تحلیلی هستیم.<br />  https://clk.journals.pnu.ac.ir/article_5201_b607be2c85fd7b770c4c5168abbab3c0.pdf
