One of ancillary actions provided in civil procedure is the action of third party intervener <br />(article 130th of civil procedure code). The actions of third party intervener are divided into two <br />types: first the actions of original third party intervener, and, second, the actions of accessory third <br />party intervener. Most of the researches have studied the actions of original third party intervener, <br />and have paid no more attention to the accessory action of original third party intervener. Also the <br />role of the accessory third party intervener and the limits of his/her authority in original or accessory <br />actions are not considered by lawyers and judicial precedents. Furthermore the position of accessory <br />third party intervener against the other ancillary actions hasn’t been mentioned. So the aspects of <br />actions of accessory third party intervener have stayed ambiguous. This research attempts to describe <br />the action of accessory third party intervener. Its position in and its influence on original action and <br />other ancillary actions are studied in this research too. در قانون آیین دادرسی مدنی مقررات مربوط به دعاوی طاری، دعوای اضافی، ورود شخص ثالث، جلب شخص ثالث و متقابل در مواد 130 الی 134 آمده است. یکی از دعاوی طاری که در قانون آیین دادرسی مدنی پیش‌بینی شده، دعوای وارد ثالث است (مادۀ 130 الی 134 قانون آیین دادرسی مدنی). دعوای وارد ثالث به دو نوع وارد ثالث اصلی و وارد ثالث تبعی تقسیم می‌شود. اکثر نویسندگان حقوقی در مطالعۀ دعوای وارد ثالث، دعوای وارد ثالث اصلی را مورد مطالعه قرار داده­اندو دعوای وارد ثالث تبعی به طور مستقل مورد توجه حقوق‌دانان و رویۀقضائی قرار نگرفته و به نقش وارد ثالث تبعی و حدود اختیارات او در دعوای اصلی و همچنین موضع او در قبال سایر دعاوی طاری اشاره‌ای نشده است؛بنابراین ابعاد دعوای وارد ثالث تبعی و آثار ورود او در دعوای اصلی، مبهم باقی مانده است. در این مقاله سعی شده ابتدا ثالث در دعوی تبیین و سپس دعوای وارد ثالث اصلی و وارد ثالث تبعی و شرایط طرح دعوی از طرف هر کدام از آن­ها و سپس تأثیر ورود آن­ها بر دعوای اصلی مورد مطالعه و بحث قرار گیرد. <br />همچنین حقوق وارد ثالث تبعی در دفاع و در طرح سایر دعاوی طاری و اثر حکم بر او از جمله اعتبار امر قضاوت شده مورد بحث قرار گرفته است. در این مقاله سعی شده دعوای وارد ثالث تبعی در حقوق ایران و فرانسه مورد مطالعه تطبیقی قرار گیرد. https://clk.journals.pnu.ac.ir/article_3387_e4208cfe06c18fa239f9ad179160cee0.pdf
